Overstreet & Associates is a civil litigation firm.  We provide our clients with a full range of services in bringing them out of the crucible of a trial, by preparing the client and each of their witnesses so as to be prepared to eliminate the stress and tension of litigation, equipping the client and their witnesses to deliver effective testimony and evidence by partnering with our clients and shouldering the burden of the case. The firm has a varied client base ranging from small family operations to large, publicly traded corporations.

Premise conditions in varying settings relating to government-owned and privately owned properties, athletic and recreational events, school sites, roadway and railroad grade crossings.

The kind of litigation ranges from defending actions involving personal injuries in arising from accidents and abuse, ranging from a simple car accident caused injuries to catastrophic injuries and death claims. Injury litigation defended includes those involving police officers during arrest and during imprisonment, of both personal injury and civil rights claims.

Injury and death claims have included those which were negligently or intentionally caused. A number of the intentionally caused incidents also involved serious claims against the institution for licensing deficiencies or with associated convictions for murder, homicide and vehicular homicide. While a number of files involved punitive damage claims, there had yet to be clients who have been required to pay punitive damage claims to date.

Construction contract and defect litigation has involved defense of  structural construction defects, defective concrete in 5-acre buildings and sophisticated atmospheric controlling and refrigeration equipment for large agricultural storage facilities, as well as litigation over contract terms and conditions for the job, as well as insurance and indemnity clauses.

In addition to litigation, we regularly utilize alternative dispute resolution including mediation, arbitration and mini-trials.
